This document constitutes a legal agreement (the "Agreement") between you ("User," "You," "Student," or "Instructor") and Ostitto ("Platform," "We," "Us," or "Our") concerning your use of our services, courses, and products. By accessing or using the Platform, you agree to be bound by these Terms and Conditions.
1 General Terms and Modifications
1.1 Agreement: By using this Platform, you agree to be bound by these Terms and our Privacy Policy.
1.2 Modifications: We reserve the right to change these Terms at any time. Your continued use of the Platform following the effective date of any changes constitutes your acceptance of the modified Terms.
1.3 Age Restriction: You must be at least 18 years old to use our services. Users under 18 must use the Platform with the consent and supervision of a parent or legal guardian.
2 Services and Content
2.1 Courses and Access: The Platform provides various online courses, tutorials, and educational materials ("Content"). You will be granted access to purchased or subscribed courses according to the stipulated terms and timeframes.
2.2 Content Ownership: All Content (videos, text, graphics, etc.) available on the Platform is the property of the Platform or its content providers and is protected by copyright laws.
2.3 Prohibited Use (All Users): You are strictly prohibited from downloading, copying, duplicating, reselling, or distributing the Content publicly. Unauthorized use of the Content is strictly forbidden.
3 User Account and Security
3.1 Account Creation: You may be required to create an account to use the Platform and must provide accurate, complete, and up-to-date information.
3.2 Account Responsibility: You are solely responsible for all activities that occur under your account and for maintaining the confidentiality of your password.
4 Payments, Pricing, and Refunds
4.1 Pricing: The prices for all courses and services will be displayed on the Platform.
4.2 Refund Policy: The policy regarding refunds is specifically outlined at the Refund Policy page of the Platform. You agree to read and understand this policy before making any purchase.
Generally: No refunds will be granted after accessing the course for a specific time or viewing a certain number of classes/videos.
5 User Conduct and Communication
5.1 Lawful Use: You agree to use the Platform only for lawful purposes and in compliance with all applicable laws and regulations of Bangladesh.
5.2 Prohibited Behavior: You shall not engage in any activity that disrupts the experience of other users, damages the Platform or its servers, or uploads/posts any harassing, defamatory, obscene, or harmful content.
6 Adherence to Organizational Policies
6.1 Policy Compliance: All Instructors working on our Platform are obligated to operate under the internal rules, guidelines, and administrative decisions of the Platform. These policies may change from time to time to maintain the Platform's high standards.
7 Employment Commitment and Probation Period
7.1 Commitment Period (Non-Compete): Upon joining or contracting with the Platform, an Instructor shall not be engaged in direct teaching or content provision with any competing EdTech platform or similar institution for a period of two (2) months from the date of joining. This 2-month period is considered the Instructor's Commitment Period to the Platform.
7.2 Probation and Remuneration: This two (2) month period will be considered the Probation Period. Upon the successful completion of this Probation Period, the Instructor will be provided with the salary and allowances determined according to the terms of their contract.
8 Content Ownership and Rights
8.1 Content IP Rights: Once an Instructor creates or provides course Content under the agreement with the Platform, the full Intellectual Property Rights and ownership of that Content shall belong to Ostitto.
8.2 Usage and Control: The Platform reserves the right to use, modify, license, or distribute this Content in any medium, at any time.
9 Consequences of Violation and Legal Action
9.1 Disciplinary Action: If an Instructor engages in any activity that violates the Platform's rules or is outside the bounds of the law, the Platform Authority shall have the right to take disciplinary action.
9.2 Legal Recourse: This action may extend from revoking account access and termination of the contract, up to and including legal action. The Authority reserves the right to pursue legal means to recover any financial losses incurred by the Platform due to the Instructor's rule violation.
10 Limitation of Liability and Governing Law
10.1 Limitation of Liability: The Content provided by the Platform is for educational purposes and does not guarantee specific outcomes. To the maximum extent permitted by applicable law, the Platform, its directors, employees, or agents shall not be liable for any direct, indirect, incidental, special, or punitive damages arising from your use of, or inability to use, the Platform.
10.2 Governing Law: These Terms shall be governed by and construed in accordance with the laws of Bangladesh. Any disputes related to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Dhaka.
